At Lions Gate Hospital Foundation (the Foundation), we respect your privacy. Keeping our donors' records and information in strict confidence is a priority for us.
The following document includes our policies and procedures and describes how we collect, use and disclose your personal information
while respecting your rights to its protection.
The Foundation is committed to protecting the privacy of the personal information of its donors. We value your trust and recognize that maintaining this trust requires that we be transparent and accountable in how we treat the information that you choose to share with us. During the course of our various campaigns and activities, we must gather and use personal information. Anyone from whom we collect such information are assured that it will be carefully protected and that any use of this information is subject to your consent, unless otherwise permitted or required by law. We have designed our privacy policy to achieve this goal. The Foundation is committed to:
- limiting the collection, use and disclosure of your personal information to that reasonably required to carry on our affairs;
- ensuring appropriate safeguards are in place to protect the personal information we have in our custody or control;
- protecting the confidential nature of personal information when dealing with other organizations; and
- honouring your reasonable requests to review, update, or correct your personal information.
| Defining Personal Information |
Personal information is any information about an identifiable individual. This information can include an individual’s opinions and beliefs, as well as facts about the individual’s name, gender, age, family status, and personal identification numbers. It does not include business contact information.
Personal information gathered by
the Foundation
is kept in confidence. The Foundation’s staff is authorized to access individuals’ personal information based only on the purpose for which the information was obtained. All staff is trained in confidentiality and security procedures and new staff members must sign a confidentiality agreement when they are hired.Safeguards are in place to ensure that personal information is not disclosed or shared more widely than is necessary to achieve the purpose for which it was gathered. We also take measures to ensure the integrity of this information is maintained and to prevent it from being lost or prematurely destroyed.
The Foundation collects, uses and discloses your personal information for the following purposes:
- processing your donation;
- reporting your donations as required by law (i.e. to the Canada Revenue Agency);
- complying with legal and regulatory requirements.
The above collections, uses and disclosures are a necessary part of the Foundation’s work and its relationship with you. Whenever the Foundation collects personal information from you, we will state the purpose of the collection.
The Foundation may also collect, use and disclose your personal information for the following purposes:
- issuing a receipt to you;
- contacting you regarding future campaigns and special events (such as private receptions, open houses, equipment unveiling, and other events); and
- recognizing your contributions, including posting your name on the Foundation’s donor walls.
You may instruct the Foundation to refrain from using or sharing your personal information for the “other purposes” stated above by providing written notification to the Foundation’s Privacy Officer.
| Disclosure of Personal information |
We do not rent, sell, lend or trade our donor mailing lists, phone numbers or e-mail addresses to any third party.
We do use third party suppliers to process information and to provide printing services. We select these companies carefully and they must each adhere to and sign a privacy agreement with the Foundation.
The Foundation will obtain your consent to collect, use or disclose personal information except in those specific circumstances where provincial legislation provides that the Foundation is required by law or otherwise authorized to collect, use or disclose personal information without your consent. For example, the Foundation may collect, use or disclose personal information without your consent where:
- the information is publicly available, as defined by statute or regulation;
- the Foundation is obtaining legal advice; or
- the Foundation reasonably expects that obtaining consent would compromise an investigation or proceeding.
- As required by law.
Your consent can be expressed, implied or given through an authorized representative such as a lawyer, agent or broker. Your consent may be provided orally, in writing, electronically, through inaction (such as when you fail to notify the Foundation that you do not wish your personal information collected, used or disclosed for various purposes after you have received notice of those purposes) or otherwise. You may withdraw your consent at any time by phone, fax or email, subject to legal and contractual restrictions, provided that you give reasonable notice to the Foundation. If we receive notice that you are withdrawing your consent, the Foundation will inform you of the likely consequences of the withdrawal, which may include the inability of the Foundation to provide certain services for which that information is necessary.
You have a right to access your personal information held by the Foundation. Upon written request and authentication of your identity, the Foundation will provide you with your personal information under its control, information about the ways in which your information is being used and a description of the individuals and organizations to whom that information has been disclosed.
The Foundation will make the information available within 30 days or provide written notice where additional time is needed to fulfill the request.
In some situations, the Foundation may not be able to provide access to certain personal information (i.e. if disclosure would reveal personal information about another individual, the personal information is protected by solicitor/client privilege, the information was collected for the purposes of an investigation or where disclosure of the information would reveal confidential commercial information that could harm the competitive position of the Foundation). The Foundation may also be prevented by law from providing access to certain personal information.
Where an access request is refused, the Foundation will notify you in writing, document the reasons for refusal and outline further steps that are available to you.
If you have any questions about a refusal of an access request, contact the Foundation’s Privacy Officer.
The Foundation will make a reasonable effort to ensure that personal information we are using or disclosing is accurate and complete.If you notice an inaccuracy or incompleteness in your personal information, please let the Foundation know, and we will endeavour to amend the information as required. If appropriate, the Foundation will send the amended information to third parties to whom the information has been disclosed. When an issue regarding the accuracy of personal information is not resolved to your satisfaction, the Foundation will annotate the personal information under its control with a note that the correction was requested but not made.
| Website and Electronic Commerce |
The Foundation uses password protocols and encryption software to protect personal information we receive when a donation or service is requested and paid for online. Our software is routinely updated to protect such information. To protect your privacy, the Foundation adheres to the following principles:
- We will not gather any personal information from you, unless you give it voluntarily;
- We do not use “cookies” to track our visitors’ use of this website;
- We do not trade, rent, sell or disclose personal information to anyone except the Foundation and its employees, agents, officers and directors, and except as described above under the “Disclosure of Personal Information” heading;
- We take reasonable measures to protect your personal information from loss, misuse, unauthorized access, disclosure, alteration or destruction.
At times we may request that you voluntarily supply us with personal information, such as your e-mail or mailing addresses, for purposes such as entering a contest, making a donation, subscribing to our e-newsletter or participating in an online survey. However, when at all possible, an option to remain anonymous will be provided to those who wish to preserve their right to anonymity. When you supply the Foundation with your personal information over the website, we may use it to:
- guide the development of new features and services relevant to web users;
- contact you by e-mail, direct mail or telephone about future events, promotions or fundraising campaigns; and
- provide further information related to the purpose for which you supplied personal information.
| Destruction of Information |
We keep your information only so long as we need it or are required to keep it by law. We destroy your information when it is no longer needed, or we remove your name from the information. We will take due care when destroying personal information so as to prevent unauthorized access to the information. We will keep personal information used to make a decision affecting you for at least one year after using it to make the decision.
