Protection Guidelines |
At Lions Gate Hospital Foundation (the Foundation), we respect
your privacy. Keeping our donors' records and information in strict
confidence is a priority for us.
The following document includes our policies and procedures
and describes how we collect, use and disclose your personal information.
The Foundation is protecting the privacy of the personal information
of its employees, volunteers, donors and other stakeholders. We value
the trust of those we deal with, and of the public, and recognize
that maintaining this trust requires that we be transparent and accountable
in how we treat the information that you choose to share with us.
During the course of our various
campaigns and activities, we frequently gather and use personal
information. Anyone from whom we collect such information should
expect that it will be carefully protected and that any use of or
other dealing with this information is subject to consent (unless
otherwise permitted or required by law). Our privacy practices are
designed to achieve this.
| Defining
Personal Information: |
Personal information is any information about an identifiable
individual. This information can include an individual's opinions
and beliefs, as well as facts about, or related to, the individual.
It does not include business contact information.
Personal information gathered by our organization is kept in
confidence. Our personnel are authorized to access personal information
based only on their need to deal with the information for the reason(s)
for which it was obtained. Also, anyone accessing an electronic donor
record needs to have an authorized username and password. Different
levels of access are given to staff members depending on the nature
and requirements of their work. All staff are trained in confidentiality
and security procedures and new staff must sign a confidentiality
agreement when they are hired.
Safeguards are in place to ensure that the information is
not disclosed or shared more widely than is necessary to achieve
the purpose for which it was gathered. We also take measures to
ensure the integrity of this information is maintained and to prevent
its being lost or destroyed.
We collect, use
and disclose personal information only for purposes that a reasonable
person would consider appropriate in light of the circumstances.
Consent:
The Foundation will obtain
your consent to collect, use or disclose personal information except
where the Foundation is authorized or required by law to do so without
consent. For example, the Foundation may collect, use or disclose
personal information without your knowledge or consent where:
- the information is publicly available, as defined by statute
or regulation;
- the Foundation is obtaining legal advice; or
- the Foundation reasonably expects that obtaining consent would
compromise an investigation or proceeding.
Other exceptions may apply.
Your consent can be express,
implied or given through an authorized representative such as a
lawyer, agent or broker.
Consent may be provided
orally, in writing, electronically, through inaction (such as when
you fail to notify the Foundation that you do not wish your personal
information collected, used or disclosed for various purposes after
you have received notice of those purposes) or otherwise.
You may withdraw consent
at any time, subject to legal and contractual restrictions, provided
that you give reasonable notice of withdrawal of consent to the
Foundation. Upon receipt of notice of withdrawal of consent, the
Foundation will inform you of the likely consequences of the withdrawal
of consent, which may include the inability of the Foundation to
provide certain services for which that information is necessary.
| Disclosure
of Personal information: |
We do not rent,
sell, lend or trade our donor mailing lists, phone numbers or e-mail
addresses to any third party. We do use third party suppliers to
process information or to provide printing services. We select these
companies carefully and they must each sign a privacy agreement.
When collecting information,
the Foundation will state the purpose of collection and will provide,
on request, contact information for the Privacy Officer who can
answer questions about the collection.
Required Purposes:
The Foundation collects,
uses and discloses your personal information for the folliwng reasons:
- to process your donation;
- to report your donations as required by law (i.e. to Canada
Revenue Agency);
- to manage or transfer assets or liabilities of the Foundation;
and
- to comply with legal and regulatory requirements.
The
above collections, uses and disclosures are a necessary part of
the Foundation's relationship with you.
Other Purposes:
The Foundation may also
collect, use and disclose your personal information for the folliwng
purposes.
- issuing a receipt to you;
- contacting you regarding future campaigns and special events
(such as private receptions, open houses, equipment unveiling,
and other events); and
- donor recognition, including posting your name on the Foundation's
donor walls.
You may instruct the Foundation
to refrain from using or sharing information in the three ways described
above under "Other Purposes" by providing written notification
to the Foundation's Privacy Officer.

and Electronic Commerce: |
We use password protocols and encryption software to protect
personal and other information we receive when a donation or service
is requested and/or paid for online. Our software is routinely updated
to protect such information.
To
protect your privacy, the Foundation adheres to the following
principles: |

will not gather any personal information from you, unless you
give it voluntarily. |

We do not use "cookies"
to track our visitors' use of this website. |

Any personal information
will not be traded, rented, sold or disclosed to anyone except
the Foundation and its employees, agents, officers and directors,
and except as described above under the "Disclosure of
Personal Information" heading. |

We take reasonable
measures to protect your data from loss, misuse, unauthorized
access, disclosure, alteration or destruction. |

At times we may
request that you voluntarily supply us with personal information,
such as your e-mail address and postal address, for purposes such
as entering a contest, making a donation, subscribing to our e-newsletter
or participating in an online survey. However, when at all possible,
an option to remain anonymous will be provided to those who wish
to preserve their right to anonymity.
Providing
Access:
You have a right to access
your personal information held by the Foundation
Upon written request and
authentication of your identify, the Foundation will provide you
with your personal information under its control, information about
the ways in which your information is being used and a descriptin
of the individuals and organizations to whom that information has
been disclosed.
The Foundation will make
the information available within 30 days or provide written notice
where additional time is required to fulfil the request.
In some situations, the Foundation
may not be able to provide access to certain personal information
(i.e. if disclosure would reveal personal information about another
individual, the personal information is protected by solicitor/client
privilege, the information was collected for the purposes of an
investigation or where disclosure of the information would reveal
confidential commercial information that could harm the competitive
position of the Foundation). The Foundation may also be prevented
by law from providing access to certain personal information.
Where an access request
is refused, the Foundation will notify you in writing, document
the reasons for refusal and outline further steps which are available
to you.
Accuracy:
We will make a reasonable
effort to ensure that personal information we are using or disclosing
is accurate and complete.
If you demonstrate the
inaccuracy or incompleteness of personal information, we will amend
the information as required. If appropriate, the Foundation will
send the amended information to third parties to whom the information
has been disclosed.
When a challenge regarding
the accuracy of personal information is not resolved to your satisfaction,
the Foundation will annote the personal information under its control
with a note that the correction was requested but not made.

of Privacy Policy: |
We regularly review our privacy practices for our various activities,
and update our policy. Please check our Website on an on-going basis
for information on our most up-to-date practices.
| Destruction
of Information: |
We keep your information
only so long as we need it and are required by law. We destroy your
information when it is no longer needed, or we remove your name
from the information. We will take due care when destroying
personal information so as to prevent unauthorized access to the
information.
We will keep personal
information used to make a decision affecting you for at least one
year after using it to make the decision.
